Answer

Q1
In this scenario, if the company allows the product to released into the market , it will lead to damaging the reputation of the software and the company. So even if an improved version is released later it will not generate interest from the customers citing previous bad experience. And the end result would be to face loses. Therefore better option would be to restart the product with the team and let the developers continue. And in the future ensure proper steps are taken to deliver a quality product.
Q2Well working in a firm requires a lot of skills that may vary from leadership skills to persuasive skills, so with this dealing with wrong issues is also a skill and needs to be perfected upon.
In this case as I know Jacob is using a software which is illegal and can lead to privacy and data issues for company so being a loyal and ethical employee I will try my level best that things get clear and the real culprit suffers the punishment because if the data gets leaked then some serious issues will come from the government department. So I will take these steps to solve the issue:
Will approach directly Jacob to take down the applicationWill approach the managers of all levels regarding the issueWill create a team that will approach the HOD to give Jacob a written warningWill go to CEO if Jacob found using the illegal applicationWill go to employee (labor) court if the case doesn’t solveThis is a hierarchy that I will follow if things doesn’t go right.
Also, since in am a part of the company I would not want my company to be in any risky position as the company i am working in is my first priority and my loyalty toward it always stands ahead of me and also don't want the person who helped me throughout to be retrenched from the company in this concern.
In my opinion, if i were in this place i would have approached JACOB personally again and make him understand the risks associated with the unlicensed software though proper evidences so that he gets to understand the problem. I would gather certain information of other companies and data on the concerned issue and present all the information in front of jacob first as he has my success support and i would not want him to bear the harsh consequences later. If he understands my point of view then i would request him to make it understandable to its support staff even in which i would help him.
And, after this he isn't convinced with my thoughts and continous to use that software i would be compelled to take the case to the CEO of the company and ask him to take necessary actions as it would not be possible for me to take any action independently.
