Essay Question:

Read “The Case of Impossible Education” beginning on page 246 in the class text. Answer the following questions:

1. How does the court define “impossibility of performance”?
2. Pursuant to the court’s ruling, what effect does a frustrating event have if it was foreseeable?
3. What are the reasons why the defendant argued that the contract should not be enforced? Did the court agree with these reasons?
